Updated Liability Information for Passengers

Carriage under this ticket is subject to the provisions of the Swiss Ordinance on Air Transport (LTrV; SR 748.411) in force at the time of the flight and, where applicable, to the Montreal Convention of 28 May 1999 (MC99). These rules govern the liability of the air carrier for death or bodily injury of passengers, for destruction, loss or damage to baggage, and for delay.

The carrier’s insurance coverage complies with Regulation (EC) No 785/2004, which sets minimum insurance requirements for air carriers and aircraft operators.

1. Liability for Death or Bodily Injury

  • The carrier’s liability for proven damages is strictly unlimited.
  • For damages up to 151'880 Special Drawing Rights (SDR) per passenger, the carrier cannot exclude or limit its liability.
  • For damages exceeding this amount, the carrier may be exonerated from liability to the extent it proves that the damage was not due to its negligence or other wrongful act or omission, or that such damage was solely due to the negligence or wrongful act or omission of a third party.
  • In the event of death or injury, the carrier shall make an advance payment to cover immediate economic needs within 15 days of the identification of the person entitled to compensation. In case of death, this payment shall not be less than 16,000 SDR.

2. Liability for Baggage

  • In the case of destruction, loss, damage or delay of checked baggage, the liability of the carrier is limited to 1'519 SDR per passenger.
  • A passenger may benefit from a higher liability limit by making a special declaration of interest in delivery at destination and by paying a supplementary fee if applicable.

3. Liability for Delay

  • For damage caused by delay in the carriage of passengers, the carrier’s liability is limited to 6'303 SDR per passenger, unless the carrier proves that it took all reasonable measures to avoid the damage or that it was impossible to take such measures.

4. Set-Off of Other Payments

  • Any payments made to the entitled persons under any personal accident insurance policy taken out by the carrier or the aircraft operator, as well as advance payments made pursuant to applicable liability rules, shall be fully deducted from any compensation payable under the carrier’s liability.
